Use of the Onstage411 website is offered to you on your acceptance of these Terms of Use, Privacy Policy and other notices posted on this site. Your use of this website indicates your acknowledgment and agreement to the Terms of Use, Privacy Policy and other relevant notices. If you do not agree to be bound by all of the foregoing, you may not access or use the Onstage411 website. Onstage411 reserves the right to change these Terms at any time by posting them on the Onstage411 site.

Permitted Use
The content on the Onstage411 site (i.e., the information, images, and software) is the property of Onstage411 and/or third parties supplying information to the Onstage411 site. As such, the site’s contents are protected by U.S. and international copyright laws. You are only authorized to view and to retain a copy of pages of the Onstage411 site for your own personal use. Any further distribution, publication, reproduction or public exhibition of materials provided at this site in whole or in part is strictly prohibited.

Links and Third-Party Sites
Onstage411 has no control over third-party sites linked to the Onstage411 site or over the content within them. Onstage411 does not warrant that these Third Party sites will not impact your computer or that the content contained of third-party sites is accurate, complete, and/or legal. By using the Onstage411 site, you indemnify and hold harmless Onstage411 for any damages or losses whatsoever resulting from use of third-party sites.

Onstage411 does not promise that the Onstage411 site or any services (including, but not limited to products, pricing, email, links or special offers), will be uninterrupted or error-free. Likewise, Onstage411 cannot guarantee specific results from use of the Onstage411 site or any content, search or link contained therein. Onstage411 cannot warrant that files downloaded from the Onstage411 site will be free of destructive features such as viruses or contamination.

Indemnity
You agree to indemnify and hold Onstage411, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Onstage411 site.

IN NO EVENT WILL Onstage411 BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES.

Affiliations
Onstage411 is not affiliated with event service providers furnishing tickets for the Onstage411 site. Onstage411 is acting solely as intermediary between producers, venues and ticket purchasers. Onstage411 assumes no liability arising from an event for which tickets are purchased or sold. Purchaser assumed all risks associated with event attendance.

Delivery, Pricing, Availability and Seating
While options for ticket delivery, pricing, availability and seating are listed on the Onstage411 site, all of these are determined solely by production entities. Ticket purchaser assumes all risk regarding ticket delay, loss, damage, or destruction during delivery. Onstage411 assumes no responsibility for tickets stolen, lost, damaged, delayed or destroyed during delivery.

Event ticket prices are set by the event production entity, and not Onstage411. For most ticket sales, Onstage411 will charge between US$.99 and US$3.50 plus up to 2.5% of the face value of each event ticket as a service fee. In some instances, or for certain special events, service fees may be higher.

The event production entity sets the number of tickets sold or offered as promotion for an event, not Onstage411. As a result, Onstage411 will not be held liable for sold-out performances, limitations in quantity of special offers, or ticket over sales. In the rare event tickets are oversold by the production entity, the production entity has discretion as to the method of refund, including but not limited to price refund, or ticket exchange for a similarly equivalent event.

Seating charts are provided by production entity, and/or the venue, not Onstage411. Onstage411 will not be held responsible for incorrect seating information, or ticket holder dissatisfaction with selected seating. Any seating dispute is between ticket purchaser and production entity and/or venue. Mailing costs and/or service charges will not be refunded if event tickets are oversold, or if a ticket purchaser is dissatisfied with seating selected.

Will Calls
Ticket purchasers choosing to pick-up tickets at Will Call may do so at event venue box office or point of entry unless otherwise instructed. PLEASE NOTE: Both a PHOTO ID and the ORIGINAL CREDIT CARD used to make the purchase may be required in order to gain entry, and is determined by the event producers. Onstage411 may not grant a refund if ticket purchaser fails to appear for Will Call List entry, or fails to provide proper photo identification and/or the original credit card. Purchaser agrees that purchaser's name, city and state of residence, and a portion of ticket purchaser's credit card number will be given to venue and production entity to verify ticket purchaser identity.

Cancellations
Production entities or others beyond the control of Onstage411 may cancel or reschedule events. Onstage411 can provide instructions on how to exchange certain tickets, or obtain refunds, but these refunds or exchanges are at the discretion and the responsibility of the production entity. Service fees cannot be refunded in the event of a canceled or rescheduled event.

Refunds and Exchanges
All sales are final. Onstage411 cannot refund or exchange tickets, except in cases of cancellation or reschedule, according to terms set by production entities. Service fees cannot be refunded.

Order Cancellation
Onstage411 reserves the right to cancel order or orders for any reason, including for reasons of incorrect billing or fraudulent ticket purchasing.

Resale
Any ticket resale will automatically void tickets and bar entry to event, with no possibility of refund or exchange.

Location for Resolving Disputes
If there is any dispute about the Onstage411 site or involving the Onstage411 site, you agree that the dispute will be governed by the laws or the State of California without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and federal courts of the State of California, County of Los Angeles.

Effective Date
These terms, conditions and policies are effective as of June 1, 2010.
